Among them, communication optical (electric) cables, machine rooms, iron towers, base stations, pipeline lines, etc. belong to communication infrastructure. The method proposes that communication infrastructure belongs to public infrastructure

Administrative Measures for the construction and protection of communication facilities in Qingdao

Chapter I General provisions

Article 1 is to regulate and ensure the construction of communication facilities and protect the safety of communication facilities. These measures are formulated in accordance with the provisions of the Telecommunications Regulations of the people's Republic of China and other relevant laws and regulations, and in combination with the actual situation of the city

Article 2 the measures are applicable to the construction, protection and related management of communication facilities within the administrative area of this city

the communication facilities mentioned in these Measures refer to the communication equipment, communication lines and communication supporting facilities that form the communication network system to provide communication services for the society. Among them, communication optical (electric) cables, machine rooms, iron towers, base stations, pipeline lines, etc. belong to communication infrastructure

Article 3 the construction and protection of communication facilities shall follow the principles of overall planning, reasonable layout, military civilian integration, joint construction and sharing, and ensuring security

communication infrastructure belongs to public infrastructure. As a strategic public infrastructure, broadband network should be given priority

Article 4 the municipal and district (city) people's governments shall establish a joint meeting system for the construction of communication facilities to coordinate the construction and protection of communication facilities. The daily work of the joint meeting shall be in the charge of the municipal competent department of communications and the departments determined by the district (city) people's government

Article 5 the municipal competent department of communication is responsible for the supervision and management of the construction and protection of communication facilities in the city. The departments determined by the district (city) people's Government shall assist in the construction, protection, supervision and management of communication facilities

the competent departments of economy and informatization, urban and rural planning, and urban and rural construction shall do a good job in the construction and protection of communication facilities in accordance with their duties. Development and reform, public security, finance, land and resources, urban management, environmental protection, market supervision, transportation, forestry, water conservancy, radio and television, maritime, marine, fisheries and other relevant departments shall do a good job in the construction and protection of communication facilities in accordance with their responsibilities

the Township People's government and the sub district office shall assist in the construction and protection of communication facilities

Article 6 the relevant departments of communication and environmental protection, as well as the property right units of communication facilities and the media should publicize and popularize the knowledge of communication security protection through various forms, improve the scientific awareness of the society on the green and environmental protection of communication, and support and cooperate with the construction of communication facilities. Encourage and support science and technology associations, experts and scholars to participate in communication and science popularization

no unit or individual shall hinder the construction and maintenance of communication facilities and endanger the safety of communication facilities

Article 7 the construction of communication infrastructure shall be incorporated into the national economic and social development planning, urban planning, land use planning and urbanization development planning, so as to promote the development of communication undertakings in this region

Article 8 the municipal competent department of Communications shall, in conjunction with the departments of economy and information technology, urban and rural planning, urban and rural construction, radio and television, prepare special plans for communications infrastructure, which shall be implemented after being approved by the Municipal People's government

when preparing the special plan for communication infrastructure, the opinions of the military, maritime, commercial, emergency, environmental protection, transportation, electric power and other relevant departments shall be solicited

the planning of communication infrastructure should be connected with the planning of power facilities, and the needs of power introduction and communication pipeline setting of communication equipment and communication supporting facilities should be coordinated

Article 9 when preparing the regulatory detailed plan, the space, layout and construction time requirements determined in the special plan for communication infrastructure should be taken into account as a whole, the location and scale of land should be clarified, the requirements for the construction and control of communication pipelines should be put forward, and the communication facilities should be included in the management of the urban yellow line

urban and rural planning departments should include the relevant contents of communication infrastructure planning in the planning and design conditions for the transfer of state-owned land use rights, and take the design of communication infrastructure as an important part of the review of the design scheme of construction projects

the construction projects of independently occupied iron towers and base stations should go through the planning approval procedures; The construction projects of attached iron towers and base stations shall meet the requirements of environmental protection and land intensive utilization

Article 10 the land administration department shall integrate the land demand for communication infrastructure construction into the overall land use plan and the annual land use plan. Land for independently occupied iron towers and base stations can be allocated in accordance with national regulations; If it is necessary to requisition collective land, the requisition procedures shall be handled according to law

for the construction of communication facilities, the land can be used in the form of construction allocation or easement

Article 11 when preparing the annual construction plan of urban roads, the urban and rural construction department shall require the competent communication department to provide the construction plan of communication infrastructure involving roads and include it in the annual construction plan of urban roads

when planning municipal roads, green spaces, street lights and other municipal facilities, space should be reserved for communication infrastructure according to the special planning of communication infrastructure. The construction of communication facilities shall make full use of the space of underground pipelines or be attached to existing buildings (structures) and meet the city appearance standards

Article 12 public institutions and public places shall provide access convenience for the laying of communication lines, communication pipelines, channels, or the installation of small antennas, communication base stations, iron towers, machine rooms, indoor distribution systems and other communication facilities, and shall be open free of charge. After the completion of laying or installation operations, the installation unit shall restore or repair the buildings, green spaces, roads, etc. damaged in the process of operation; If it cannot be restored or repaired, compensation shall be made according to law

Article 13 the construction of communication infrastructure should follow the principle of joint construction and sharing, consider the construction plan as a whole, and meet the requirements of equal access of telecommunications business operators. When necessary, the municipal competent department of communications may organize the preparation of a joint construction plan, which shall be implemented after being submitted to the Municipal People's government for approval

Article 14 telecom business operators shall not restrict other telecom business operators' equal access by signing exclusive agreements, or hinder other telecom business operators from providing services to users or using project supporting communication facilities

no unit or individual may restrict the equal access of telecom business operators and hinder the independent choice of telecom users

Article 15 construction projects shall simultaneously design and construct supporting communication facilities. Communication pipelines, machine rooms, wiring facilities, power access and other communication facilities in buildings, as well as communication pipelines, bridges and other cable channels within the land scope of the construction project, shall be included in the design documents of the construction project, and shall be constructed and accepted at the same time with the main works of the construction project, and the required funds shall be included in the total investment of the construction project

Article 16 key public transport places such as urban rail transit, railways, expressways, airports, stations, wharves, large public venues such as gymnasiums, exhibition centers, libraries, commercial and residential buildings and commercial buildings jointly used by multiple owners, state organ buildings with a construction area of more than 3000 square meters, and other public buildings with a construction area of more than 20000 square meters shall build an indoor distribution system of communication infrastructure

if the construction of indoor distribution systems in accordance with the provisions of the preceding paragraph leads to signal blindness or congestion, which affects the quality of telecommunications services, the managers of buildings or places shall support the telecommunications business operators to set up them

Article 17 telecom operators should strengthen the construction of communication facilities in rural and remote areas. They have brought three kinds of new material products: general-purpose water-soluble film, marine environment-friendly plastic and plant protective plastic, and improved the universal service of telecommunications. The local people's Government shall provide support and convenience in its construction, land use, compensation, power supply and other aspects

Chapter III security protection

Article 18 the municipal competent department of Communications shall supervise and inspect the operation safety of communications facilities and urge telecommunications business operators to perform the main task of maintaining communications facilities

Article 19 telecom business operators shall formulate protection and management systems for communication facilities, implement safety protection measures, and perform the following duties:

(1) regular overhaul and maintenance

(II) patrol inspection

(III) set up warning signs according to regulations, indicating the owner, manager and their contact information

(IV) set up protective facilities such as fences and fences according to regulations

(V) establish and improve the safety classification protection and risk assessment system

(VI) establish a joint defense mechanism with relevant departments and units

(VII) carry out publicity of relevant popular science knowledge and protection knowledge

Article 20 the scope of safety protection of communication facilities shall be delimited in accordance with the following provisions:

(I) the aerial communication lines inside and outside the urban area and the external power lines of the base station extend horizontally to both sides for 0.75 meters and 2 meters to the ground

(II) 3 meters on both sides of the underground communication line; 2 meters around the transformer of the base station; 50 meters on both sides of underwater optical (electric) cables in inland rivers

(III) the wide coastal waters are 500 meters on both sides of submarine optical (electric) cable pipelines; Narrow sea areas such as the Bay are 100 meters on both sides of the submarine optical (electric) cable pipeline; In the harbor area, there is submarine light (electricity
